It's possible that the original instructions were written a bit more loosely than some were comfortable with - nobody at NSA expects common sense to be a common virtue, unlike some people. So they tightened things up...and it appears to have been a great success. The NSA General Counsel tends to be a very important office in the overall structure of the place. If they let it fly, 99.9% or higher chance it was legal. People may still have been uncomfortable (it does tend to go against a lot of training), but hey, I'm uncomfortable with the speed limits around here. Doesn't mean that they aren't legal though.
