Decided by the court.  You take the risk when entering the encounter with 
deadly force.  it is your choice - be a victim or not.

Take any newspaper article that deals with a crime that evern peripherally 
involves a firearm.  Subtract those where the firearm is used for lawful 
defense.  The rest will, practically without exception deal with guns not 
legally obtained.  If gun control REALLY worked, those weapons would not 
exist,
 and could never find tierh way intot he hands of the goblins.
