We've been past that for 27 years: the Foreign Intelligence Surveillance
Act of 1978 gave government reasonably broad powers to do a domestic
wiretap with 72 hours after the fact to get a judge's approval.

Bush has yet to explain which trucks he couldn't manage to drive through that.
