To be honest with you, as an Illinois law enforcement officer, most of
my co-workers "wouldn't have a clue" if they had to distinguish a
scanner from a bag of marijuana.  Not to impugn their abilities to
figure out a radio, but many of them are lucky to be able to get past
their channel changer knobs on our MT-2000 radios.
Then again, there are others who can smell a wanted felon right through
the (illegal) tinted windows on the ghetto cruiser 'trolling down the
highway in front of them....
It's not a high priority as far as I can see.  We may run the serial #
of a scanner found in a car if other circumstances are there, but as far
as using the radio for illegal purposes, if they're doing something
wrong (in Illinois) then they can be charged with parties to a crime or
using the radio for illicit purposes.
