It would be, yes.  I seriously doubt that anyone at Dynalink would have
enough smarts to even follow the code, let alone change it.  I'd think it
more likely that licencing the base modems from USR would include
contractual agreements with USR for them to perform any firmware upgrades
and fixes to it.
