I am certainly not an expert on the Supreme court (as I have seen you
claim) but using foreign precedents has been in the news now for years. I
think one of the last cases that got quite a bit of attention was the
decision on the death penalty for juveniles.  Scalia recently gave a speech
against what he feels is a growing trend to use foreign law in decisions.
