No, Treasury isn't "telling Congress what it 'has' to do." 
Congress could just as easily thumb its nose at Bush and do otherwise, like
on the ports business.  What is really happening is that the Dems are
trying to hold the process hostage, rather like the ill-advised attempt of
the GOP to shut the government down under Clinton at one point.
