There is no current case. The state has the right to take action against
those who threaten the security of the state & if the punishment is
death then that's a sovereign decision of the state.

wrt Genocide this one's a toughy too. (A) If it was within the above (&
after all the Kurds were engaged in a separatist war (just ask the Turks)
then heck it's a civil war & in war there is "collateral
damage"

(B) Depends on the orders given e.g. some kind "who will rid me of
this troublesome priest?" won't do. i.e. If Saddam said "crush
the separatists etc" then heck that's been said by putin wrt the
chechens, various Israeli leaders wrt the Palestinians, PRC wrt the turkics
& tibetans etc.etc.
