In point of fact federal judges up to and including the Supreme Court,
have been selected for their political ideologies, not for any legal, judicial
or Constitutional expertise, since at least Roosevelt minor's administration.

Uh, yes it does.  Those powers not specifically granted to the national
government are reserved to the states or to the people.  Not some powers,
ALL powers.  If the Constitution doesn't say the national government can do
something, it cannot (Constitutionally) assume that it has the power to do so;
the fact that it does exactly that is the fault of the courts and, ultimately, the
people.
