It's probably your line, and there's nothing you can do about that. 
Although my Courier usually connects at 31k2 or 33k6, I sometimes have
problems with my lines early in the morning (buggered if I know why), and
get really strange assymetrical link rates, like this one...

Note that it negotiated the highest symbol rate (3429), yet my Rx speed
actually trained DOWN during the call, from 12k to 9k6, although my Tx
speed was 31k2.  And a S/N ratio of just 18db?  What a bloody joke!

Beats me what Telstra is doing to our local lines...  :(
