Know Your Rights!
The Bill of Rights, part of the United States Constitution, is the law of
the land. Unfortunately, we the people, often forget what our rights are.
We have, through our own ignorance, allowed "the system" to strip us of our
rights and we never even raised a voice in protest. How did it happen? It
happened one little step at a time, year after year, until the system is as
it stands today. We can reverse this trend by demanding that our rights be
adhered to. We can challenge state laws, the rulings of the courts and
even "county policies" that have been declared law. We the people have a
duty to change the system when it no longer works. These are not idle
words, they are the American dreams and ideals we grew up believing in. We
can not rely on others to protect our rights, we must do it ourselves and
we must do it together. We owe it to ourselves, our children, and to
America. Learn your Constitution. Keep a list of the rights that were
violated throughout the course of your case. You can use this information
in civil law suits if you wish to proceed in that manner later on.
---------------------------------------------------------------------------
Can I sue?
Yes! Some states are changing the laws so that social workers to be sued
for violating the rights of their "clients". California is one of them.
Starting January 1, 1996 social workers will have the same immunity that
police officers have. Prior to this, social workers had complete and total
immunity for their actions. Civil law suits are forming all over the
country. Some are class action suits, some are single suits. You can find
out what suits are forming near you by calling various parents and family
rights organizations (VOCAL, MASA, Fathers For Their Children, Protective
Parents, Injustices In The Court, and so on).
Who can be sued? The state, the county, sometimes judges, social workers,
police officers, foster parents, and sometimes the federal government.
It won't be easy. It may take years to fight the battle in court, but your
fight will help the next generation and each generation after that. By
making the effort now, you are helping your children avoid the same dangers
when they become parents themselves.
----------------------------------------------------------------------------
Can I file an International Complaint?
Yes, you can file a complaint against the United States for violations of
it's Constitution. This complaint is filed with the United Nations, and
will remain as part of America's history for as long as the United Nations
stands. These complaints can be for: cruel and unusual punishment, false
imprisonment, torture (mental anguish), etc.
At this point I am not sure who to contact or how to go about doing this,
but the information should be forthcoming soon.
----------------------------------------------------------------------------
Don't forget about the local level!
Check with your County Board of Supervisors to see if they have a task
force that investigates how these cases are handled. If they do, find out
how you can present information about your case to them. If there isn't a
task force in place, see if you can get the Board of Supervisors to start
one. You may need to get other parents to go with you to speak to the Board
during public meetings, but if you can show support for this and if you are
persistant on this issue, sooner or later they are bound to give in.
You can also send copies of your complaints to the County Grand Jury.
Since their investigations are confidential, you won't know what they are
working on, but they could be in the process of investigating the agency
you are complaining about, and your letter(s) may help.
