Sorry, MG> stupid question, Austel regulations don't need a reason. :-( One interesting line of thought would be the known effect of T200 phones, and the total immunity to such bad effects that mode-3 confers. A major selling point for the informed, in other words. The Local Modem Company have delivered mode-3 in every one of their products that I've used and tested for the feature. Those are definitely T200 immune - and they know it. Having disconnect enforced by telephone handset design is not a major selling point for a modem user... immunity is. That this sale inducing feature should be forbidden in imported products is neither suprising, or novel, considering the above two points. Dial tone detection forbidden, enforced guard tone, refusal to allow the modem to dial out(!), and various other campaign points have been used over the years. Get the drift? Buy enough modems, and you will. Guaranteed. Now work out how to fix it..
