Hillary's argument
There's a big irony if President Clinton makes a recess
appointment, as early as today, of Bill Lann Lee as the chief civil
rights enforcer for the Justice Department.
Fifteen years ago, the President's wife, Hillary Rodham
Clinton, went to court, charging that temporary appointments
made by the president when Congress is not in session are
unconstitutional.
Mrs. Clinton's lawsuit was filed after President Reagan fired
her and nine other directors on the board of the Legal Services
Corp., a federal agency that provides legal services to the poor.
The president then made recess appointments to replace the
ousted Legal Services officials.
But Mrs. Clinton, who identified herself as Hillary Rodham in
the lawsuit, and her colleagues argued that Mr. Reagan abused
his constitutional powers by making recess appointments.
However, a federal judge rejected their complaint. The
judge's ruling was appealed. But by the time the case reached an
appeals court, the case was moot, since the Senate already had
confirmed replacements for Mrs. Clinton and other former Legal
Services directors.
Ken Bode, host of "Washington Weekend Review" on PBS,
recounted the tale of the failed lawsuit on the program Friday
night.
Although the Clintons apparently do not agree on the legality
of recess appointments, Mr. Bode noted, "We know they are
constitutional," thanks to the first lady's lawsuit.
