It was released under the BSD license until 3.91, but is now under their own license. The sticking point is that UW owns the trademark PINE, and doesn't allow people to distribute changes. ALPINE is under development, it's a APache v2 licensed fork. It's free enough for me, if I don't like it I can always go to MUTT.
