Subject: SB 41 social worker liability
California State Senator Maurice Johannessen has introduced a bill in the
California State Legislature to establish qualified immunity for social
workers. Under current CA case law, social workers have absolute immunity
(for
example, see, Jenkins v. County of Orange (1989) 260 Cal. Rptr. 645).
Although
some social workers do their job efficiently and effectively, many have
allowed
the absolute power to go to their heads. We have seen a rash of social
orker
abuse in California, most notably the Alicia Wade case in San Diego.
In response to this problem, Senator Johannessen introduced SB 41, a bill
which
would allow parents and children injured by reckless social workers to bring
civil action against the offending social worker. In the last few months, we
have had an overwhelming response in favor of this bill.
Do you have (or know of those who do have) information on CPS liability laws
in
other states or convincing statistics to help this bill through the
legislative
process? SB 41 is scheduled to be heard in the Senate Judiciary Committee on
April 18, 1995. Please let me know what is available out there.
