HOWARD SCAGGS spoke thusly to: DICK ROEBELT

HS> > Howard, what does a "writing" have to do with it???
HS> > She designed it. I am sure that in the file she has

HS> I wasn't advising her of the validity of a claim, that was fairly
HS>obvious, but the practicality of it. Even her lawyer advised it.
HS>How many people running a Home Office, or any small business have
HS>the time and money to pursue something like this?
You'd also be surprised how many other non-home businesses do not
really have the time or resources to pursue a lawsuit (except for non
payment of bills).
HS> I beleive at this time though that Nanci's lawyer has drafted a
HS>better contract for her to use. One with more teeth to it to
HS>make it easier, and hopefully less expensive, to protect her
HS>interests.
Ahhhh..there's the rub. That writing will only do one thing - and
that is to strengthen her position in court. BUT it will still take a
court case to settle the matter. So she is not really any better off.
Except to say that it may put some fear into the signer. I doubt that
in the instant case (the radio station) will be intimidated by such a
document. Only a notice of filing a court action will get their
attention.
So, in reality, we in the industry either have to invest a few
bucks in a lawsuit (or for at least an attorney who will write a few
nasty-grams) and stand up for principal or we get crapped upon by
every person who wishes to get something for nothing.
