Howard, what does a "writing" have to do with it???
She designed it. I am sure that in the file she has pencil
sketches, ink drawings, computer art, etc. all related to the job.
Plus that _IS_ her line of work. Those are her "writings."
And for further proof, many of us keep logs of phone calls, office
visits, call back slips, etc. all with a job ticket number written on
them for a reference...in the instant case they would relate to a b.s.
layout/design.
Can you prove, in "writing" that you own anything? Hard to do if
you create the stuff yourself vs. having a sales receipt for durable
goods.
Personally, were I her (now that I think on it some more), I'd file
that design with the Library of Congress and send the station an
injunctive notice. And, should it get to court, hope that the courts
will order a fair license fee along with damages ($250-$10,000).
Should the court find the violation willful, the damages could
escalate to $50,000. And pray that court also awards atty fees and
costs.
