Simply because it is available to be imposed is a huge injustice. The
judge should not be allowed to imposed such sanctions... period.
Allowing such judgements to be permissible is not "flexibility," but an
act of absolute power by the judicial system to do whatever they want.

I believe you read my last statement wrong, foster care is a whole
different issue. I meant that the parent on welfare must give up
custody to the other parent, assuming the other parent is not on
welfare. If both are on welfare, poor kid, the two cases counsel out.
