NOTIFICATION:
Parents or guardians of home-schooled children between ages 7 and 18
must notify the local Educational Service District (ESD) Superintendent
of their plans to educate their children at home in writing at least ten
(10) calander days prior the begining of each school year or at least
ten (10) calander days before the intended date of withdrawl from school
during the school year. This notification should include the following
information: 1) full name of each child; 2) birthdate; 3) name of
parents/guardian; 4) address; 5) phone number; 6) name of the school
district in which the child resides, or name of school the child is
presently attending or last attended. Written notification is required
for each year of home instruction and should be sent to the ESD in your

TESTING:
The parent/guardian must find a "qualified" testor to test their child.
Once the child is administered the appropriate test, the resulting scores
should be submitted to your local ESD by October 31st of the school year
in which the child is withdrawn or within eight (8) weeks of notification
to the ESD of the withdrawl of the child, whichever is later. If parents/
guardians fail to submit appropriate score information as listed above,
state law requires your local ESD to report noncompliance to your local
school district. This noncompliance will result in the removal of your
children from home school status and may make them subject to the
compulsory attendance laws for the remainder of the year.
Acceptable tests are as follows:
a) California Achievement Test, 1977, 1985 or 1992
b) Comprehensive Tests of Basic Skills, 1981 or 1989
c) Iowa Tests of Basic Skills/Tests of Achievement and Proficiency,
1982 or 1990
d) Metropolitan Achievement Battery, 1985
e) SRA Achievement Battery, 1985
f) Stanford Achievement Test Battery, 1982 or 1989
g) Tests adopted or approved by the State Board of Education qualify for use
in the required statewide assessment of students attending public schools.
The State Superintendant and the Oregon Department of Education shall make
available a list of the test publishers and their addresses.
DETERMINATION OF SATISFACTORY EDUCATIONAL PROGRESS
Upon recipt of a child's test results, the superintendant shall provide a
copy of the results to parents and shall make a determination whether
satisfactory educational progress is being made by the child as defined in
OAR 581-21-026(1)(i). No parent shall be ordered to send the child to school
based upon the results of the first annual examination submitted by the
parents
for their child to meet requirements under ORS 339.035(3).
"Satisfactory Educational Progress" means that compared to the norming
group
for a test selected from the list in Section (3) of this rule, the student
scores at or above the fifteenth percentile (Normal Curve Equivalent (NCE)
Score=28) on the composite score of the selected test or if the student's
composite score is equal to or greater than the composite score of the
previous
year.
The parent must select the age-appropriate level of any of the tests to be
administered to the child annually. ... Test results used to satisfy the
testing requirements of one year cannot be resubmitted in a succeeding year,
nor may an equivalent test and norm be repeated to satisfy the testing
requirements of the succeeding year, except when a spring test score is used
as
the initial score.
INTERSCHOLASTIC ACTIVITIES:
Oregon home educated students are eligible to participate in
interscholastic activities according to the statute enacted in 1991. As
allowed in section (1)(c), the State Board of Education requires that the
composite test score from the previous year's achievement test be at or above
the 23rd percentile in order to participate.
