A hearings officer with the Colorado Department of Revenue 
concluded that Denver police did not have probable cause 
to ask Vincent White, 41, to submit to a sobriety test when 
he was pulled over for speeding (60 in a 35 zone), despite 
the fact that police described White as having bloodshot 
and watery eyes and alcohol on his breath.

White, who was appointed by Gov. Bill Owens to fill a 
vacancy in the 18th Judicial District and is scheduled to 
take office Friday afternoon, appeared briefly at the 
Department of Revenue building in Lakewood Tuesday afternoon 
but did not attend his hearing.

White was stopped by Denver police Jan. 7 for driving 60 
mph in a 35 mph zone on Park Avenue West. When the officer 
detected alcohol on White's breath, he asked him to submit 
to a sobriety test. 

White refused, claiming that he had been stopped because 
of racial profiling.
