Larry Crane, attorney for the American Center for Law and Justice 
representing plaintiffs Promise Doe, Jane Roe, et. al. v. Sundquist and the 
state of Tennessee in a federal court challenge to Tennessee's equal access 
to adoption records legislation of last year, has announced today that by 
day's end he will file a motion for a stay against Judge John T. Nixon's 
ruling in favor of Tennessee's law.
Late Friday, August 23, Judge Nixon denied the plaintiffs' motion for an 
injunction against Tennessee's law, allowing the state to proceed with 
processing applications for adoption records. The plaintiffs will now seek a 
stay, a type of injunction, and notice of appeal from Judge Nixon's denial of 
their original motion for an injunction. Plaintiffs will ask for a suspension 
of the operation of Tennessee's law pending their appeal of Judge Nixon's 
Friday ruling pending their appeal to the Sixth Circuit Court of Appeals. 
They will ask Judge Nixon to issue a new injunction pending their appeal to a 
higher court, or, in Judge Nixon's absence, ask another District Court Judge 
to issue an injunction.
If Judge Nixon or another District Court judge denies the injunction pending 
the plaintiffs' appeal, the plaintiffs will then appeal to the Court of 
Appeals to issue an injunction preventing the Tennessee law from operating 
pending their appeal of Judge Nixon's ruling to a higher court.
Once the matter of the injunction is heard and decided, the case will go to 
the higher court of appeals, which will then set the case for a hearing on 
the merits.
