 The one thing you always fall down on is this simple fact:

 No union can force management to sell one single substandard
 product.

 Until you can get past that you have no case.

 VW always had the right to shut down the plant, and to
 absolutely refuse to ship anything that is not up to spec. That
 is how the Japanese do it. If it ain't right it doesn't go out
 the door, no matter how much it costs.

 And I doubt very much they had German managers running the
 entire management structure. Very likely just a few, if any.
