Proposed 1995 California Child Abuse and Neglect Reform Legislation
Senator Raymond Haynes:
SB 86 Attempts to revise the Malinda S. decision which allowed social
workers to give hearsay statements in their reports to the courts.  This
bill would require the hearsay declarants to be present in the court for
examination by defense counsel.
SB 402 Secures to parents the right to trial by jury in juvenile court
dependency proceedings.
Senator Maurice Johannessen:
SB41 Will reduce the absolute civil immunity of social workers to that of
police officers.
Assemblyman David Knowles:
ACA 17  An Assembly Constitutional Amendment that provides that parents
shall also enjoy the right to a jury trial in juvenile court dependency
cases under Article I, Section 16 of the Constitution of the State of
California.
AB 1347 Requires the placement of children with relatives when they are
taken from parents.
AB 1348 Provides that parents shall not be required to pay court costs or
foster care costs when the case has been dismissed by the juvenile court as
unfounded.
AB1349  Makes it a felony to make an intentionally or criminally negligent
false report of child abuse to any CPS or mandated reporter.  Penalties are
2, 3, or 4 years in prison and a $15,000 fine.
AB1350  Another relative placement bill similar to AB1347.
AB 1351 Provides that the Child Abuse registry at DOJ shall not contain any
reports that are not founded.
AB 1353 Establishes the statutory right to a jury trial in juvenile court
dependence proceedings.
AB 1354 Lowers the absolute civil immunity of social workers.
AB 1355 Similar to the above legislation.
Assemblyman Steve Baldwin:
AB 247  Requires counties to fingerprint and do criminal history checks on
social workers.
