Not just yet.  Negotiate first; then call in the lawyers if you and
they cannot come to an agreement.  Don't let them publish.  In fact
if you know who the publishers are get them in on the negotiations. 
I rather think they'll have a vested in interest sitting down at the
bargaining table before heading to court.
