-=> Quoting Nancy Eddy to All <=-
NE> Well, Frank went back to court on Friday. He was all set to tell off
NE> his lawyer, turn down the plea bargain, and ask for a court appointed
NE> attorney, but never got the chance. Once his lawyer got there (Late as
NE> usual,) they went before the judge. The judge refused to hear a NO
NE> CONTEST plea on the plea bargain, wanted a guilty plea instead, and
NE> said that if he took it, Frank would have to register as a sex offender
NE> for the rest of his life- so DO NOT under any circumstances agree to a
NE> plea bargain in one of these cases until you check it out thoroughly.
NE> Anyway, I think the DA, the first one on the case who has it again now,
NE> decided she didn't like the plea bargain her collegue had set up-and
NE> convinced the judge to turn it down. So he Gave Frank the opportunity
NE> to plead guilty. Frank's lawyer said no, that he wouldn't, and so they
NE> decided to go to trial.
I hope the trial goes well. In the long run, maybe it's better that there was
no opportunity to accept the plea bargain. I hope so, for your sake and the
sake of your family.
NE> They got a 30 to 60 day continuance, and now
NE> Frank has to decide if he wants to find another attorney-or come up the
NE> the $7,000 to keep this one. Turns out that he let us think he had
NE> already filed a discovery motion-but he hasn't-and he's been on the
NE> case for almost a year in the half. He told Frank that the DA says
NE> they had some medical proof that will put him away- but if they did-why
NE> go for the plea bargain to begin with and why wait so long to go to
NE> court now? We think the lawyer said that just to scare Frank into
NE> keeping him on. I still don't think we should have to pay him
NE> anymore, since he agreed to take the case to trial for the $4000 we've
NE> already paid him. Guess he's just gotten greedy. But then, he's a
NE> lawyer. I'll let you know what happens.
Did you have a written contract with the attorney? I hope so. If you did,
read the contract and see if it indicates that more money would be needed
if it went to trial. Although if this attorney hasn't really done everything
that he said he would, then perhaps a different attorney would be a good
idea. As for the medical "proof", I highly doubt it otherwise Frank would
be behind bars right now. What they probably have is a doctor's opinion that
"maybe" something "could" have happened, but not necessarily that it did.
I hope everything goes well and I will keep you and your family in my
prayers. We go to court on the 16th for the trial against the boys, and I'm
scared too, so YOU ARE NOT ALONE! Take care.
