His ability to vote is contingent on his voting status in New York, where he
was convicted. In NY state, a felon CAN vote so long as they are not currently
incarcerated. He was not in jail, so he was still eligible to vote.

The appeals process doesn't change anything until a ruling is made in said
appeal. If you appeal a felony conviction, until the appelate court rules
otherwise, you ARE a felon.
