Strictly speaking, the mall management didn't need to tell him.  They
should have I agree, but it's still within legal limits.

Perhaps there was something different about these 2 guys to warrant the
difference?  Besides, it's still within legal limits to enforce when you
want, and not to when you want on your own property.
