       Maybe, maybe not. Either way, I think it would be WAY too risky 
for the writers to depends on the courts.  I doubt they would be able 
(even if they wanted to) to come up with something in the contract that 
the studios would not be able to find some way around. 
   I would point to early cable. It was either DGA or Screen Actors 
Guild that got some percentage of the money the studios got from selling 
cable rights. What then happened in many cases is that the production 
divisions "sold" the rights to their cable cousins for chump change and 
made their real money off the advertising, which isn't part of the cash 
flow for figuring residuals. 
   Gross is much more transparent, I get x% of the check you get. A   
certain amount no matter what you get is better.
