       There may be a time and place to do so, but even the courts
themselves are more a poll of public opinion than the bulwark to
preserve the liberties of minorities against the tyrrany of the
majority they were intended to be.  It would be an impossible task to
even begin to count judicial reversals and the flip flops back and
forth of the courts on consitutional issues.  
       What is, obviously, is what is, but that does not make it either
right or in compliance with the Constitution.
