If the rules are inconsistently enforce the rules you open yourself up to
the possibility discrimination charges. "Something different"
could be construed as race, religion etc.
In the case of copyright and trademark if you don't defend you lose you
rights.
I'm not saying what the mall did was illegal just stupid based on the
printed press reports. Of course I probably would have had the protesters
who were creating disturbances arrested and the few who yelling at the
protesters. According to one of the print articles a scuffle broke out.
