I think you're right, but you wouldn't know anyway. HD content is only
degraded / blocked if the ICT (Image Constraint Token) is appropriately
configured. Content sourced from TV won't have it set, and I don't know of
any HD-DVDs which have it set yet. So if HD content doesn't play on your
amchine, you should be looking at drivers etc rather than HDCP.

TV is obvious, there are too many HD TV sets already sold without HDCP for
them to enable it. For DVD there is a widely reported rumour of a secret
agreement not to sell movies with ICT for the next 3 to 5 years, until the
hardware base has been sufficiently churned over to HDCP enabled equipment.
