Where on earth do you get that idea? In neither case did the court write
law. They correctly interpreted the unconstitutionality of discriminatory
laws.
Do you even understand what I am referring to with the term judicial fiat?
Do you have any idea how government works?
Here a little primer. The Legislative branch (that's Congress) writes the
laws, The Executive branch (the president) executes the laws (in a way the
president is the chief law enforcement officer) and the Judicial branch
(the courts) determine what laws are constitutional and uphold those laws
which are.
