Hi Allen,
I've been rather busy lately, so I apologize in the delay in responding to
your messages. We've been repainting the house as therapy for ourselves.
We've had to do something to brighten up our lives a little bit, even if
it's only our immediate surroundings. Oh well, at least the house is
starting to look nice. Now, on to business as usual...
I sure hope you can break the DA's immunity. Failing to act on discovery
is a pretty serious matter. I should see if I can find any info on
Milton Silverman's case that he won. Hey, maybe my "friend" can get him
as an attorney. (Wouldn't that be something!)
Which agency is "checking out" DHS? If it is the Administration For
Children and Families, I wouldn't count _too_ heavily on their help,
although in your case they may. I have a phone number for the BBS for the
Administration For Children and Families/Department of Health and Human
Services. They have some very interesting files on their system: federal
regs and all that kind of stuff that you might find useful. Their *toll
free* BBS number is: 1-800-627-8886. I hope it helps!
AC> We are also filing complaints with the local and American
AC> Psychological Association; again, laying groundwork for a civil action.
Good! I wish you luck and if I can be of any assistance, simply ask!
That's great news about the DAUBERT case. It sounds like it could benefit
an awful lot of people.
AC> I got VERY lucky in my research here and found two specific Missisippi
AC> Supreme Court decisions that followed DAUBERT and in each case,
AC> reversed because of the allowed testimony of an EXPERT. I also got
AC> very lucky and found two other cases where the psychologist who
AC> testified in our case testified in another and was all but destroyed by
AC> the judge who told her she and her testimony reminded him of "Old
AC> Salem" (The Witch Trials).
The MFCC counselor for my "friends" daughter uses anatomically correct
dolls and art therapy, and now the girl is saying things that never
happened. How nice! ( <--- Sarcasm!!! ) It's really ironic that this
girl had a medical exam proving that no sexual intercourse took place, and
yet the girl is now insisting that it did. (or so says the therapist)
My friend is not in a position to have the therapist changed at this
precise moment, but hopefully within a couple of weeks my friend will be
able to do so. One good thing though, another friend of mine has seen
this same counselor get torn apart and discredited on the stand, and my
"friend" may have to do the same thing to the counselor again.
My "friends" daughter also has a CASR worker (same as CASA, I found out).
The letterhead of the CASR office says "A child's voice in court." Yet the
recommendation the CASR worker made was after interviewing the child 6
times, the foster mother 6 times, the therapist 2 times and the social
worker 3 times. The CASR worker put in 19 hours on the case but NEVER
interviewed the parents, and this is SUPPOSED to be an unbiased opinion?
Unbiased my @$$! Good thing my friend has a VOCAL attorney - now if she
could only get a fair judge they'd be all set.
I hope the appeal will go well when it's refiled, and that you can start
the lawsuits in October like you're planning.
VF>I had no idea how many people were being railroaded until it happened
VF>to a "friend" of mine as well as to the numerous friends I have met.
AC> Yea, I know. It really has gotten WAY out-of-hand. This is about the
AC> seventh one I have really been involved in and I guess I just have had
AC> enough of these self-rightous individuals who claim to be "helping the
AC> children" when all they are doing is destroying them.
I know. My cousin is a neuro-psychologist at John Hopkins Medical Center
and he says the amount of devastation that these child-savers cause is
beyond belief. Clients (not his that I know of) have committed suicide
or wound up in psych wards because of the child-savers. It's tragic.
VF>I too believe your client is innocent.
AC> Well, I assure you, if I did not believe with every ounce of belief I
AC> have that he was innocent, I sure would not have gotten so wrapped up
AC> in this. It's real hard for me to visualize a person, no cares at all
AC> one day, and then sitting in prison the next and for something he never
AC> did. He has been there one year; one year gone from his life he can
AC> never get back and while, by other's standards a year is not that long,
AC> to me, it's a lifetime.
To your client and his family, that year is an eternity.
AC> I have never seen, in 25 years of practice, the railroad job they did
AC> in this case and no matter what happens, it will never make up for what
AC> he and his family lost.
And they will never be able to regain it again. I know all too well that
that is true. Our daughter will never be the *same* daughter that left
our home last year, and all of us have changed in ways that we aren't
happy with. I now have no respect for law enforcement or the judicial
system, and I have lost my naive belief that America is the land of
freedom and opportunity. At least now my eyes are open, but America should
be what it claims to be. What a shame that it is not.
AC> That is fantastic; the law school. We certainly need attorneys who
AC> honestly care about what they are doing and I cannot think of a better
AC> one that one that had to actually walk in the same shoes as some they
AC> may defend. As a team, you and your husband could really make a DENT
AC> together and I for one really hope it materializes.
Rest assured, it will be! This one fight that no one can afford to lose.
We must protect our families. It's a vital necessity.
