That depends. I understood in the original message, that the program was 
written for a company. I think it is no problem if this company want the 
sources, they can give an order to do so. Especially in the case that there 
is no written agreement about the rights of the company. But every legal 
system is different of course. Here in Holland I've read about a case where a 
company got the right to decompile a program that was written by another 
company, and it was written for them.
