As Kate Burke, AAC's TENOR coordinator has announced, today Judge Nixon
turned down the motions to intervene in the pending class action lawsuit
filed by the American Center for Law & Justice on behalf of birth mother
Promise Doe and others seeking to disable the adoption records access portion
of TN's 1995 adoption law.
The judge allowed the AAC and TN Coalition for Adoption Reform (TNCAR) to
have Amicus Curiae (Friend of the Court) status.
At today's hearing, as Kate wrote, Judge Nixon stated that he would issue a
written decision in a timely manner. Following that decision,Judge Nixon then
partially lifted the restraining order he had issued the last week of June,
which barred the TN DHS from disseminating information about the new law and
releasing adoption records to those individuals entitled to have them. Today,
Judge Nixon said that TN DHS could once again disseminate information about
the new law, its implementation, and who it affects. Though DHS cannot
release the records in question to applicants, Judge Nixon has said DHS can
now once again accept applications for the information and release facts
about the new law.
