TENOR REPORT FROM AAC:
On Wendesday, July 24 Judge Nixon (TN Federal Court) turned down all motions
to intervene in the pending class action law suit filed by the Center for
Social Justice on behalf of Promise Doe (a Birthmother) and others. The
decision was not a surprise to activists as the motions filed were friendly
and not hostile motions to intervene. A hostile intervention represents that
the Attorney Generals office is not adequately representing a particular
case. In this lawsuit the Attorney Generals office is working to uphold the
current Tennessee statute and therefore intervenors are not necessary. The
motions to intervene allowed activists to put before the judge good
information pertaining to open records and to show that the plaintiffs in the
lawsuit were not representative of a class (birth and adoptive parents and
adoptees). Harlan Dotson,III, representing both the AAC and Tennessee
Coalition for Adoption Reform, was granted Amicus status (friend of the
court) which will allow activists to file informational briefs for the court
to consider.
On Thursday, July 25, the preliminary injunction hearing was held in
Nashville, Tennessee. Bob Tuke (representing the TN Adoption Task Force
which drafted the current legislation) and Harlan Dotson, III, spoke at the
hearing and Fred Greenman (AAC Coordinating Attorney) attended the
proceeding. Judge Nixon withheld judgement and stated that he will issue a
written decision in a timely manner. Those in attendance at the hearing felt
hopeful about the judge's future decision.
