RICH WILLBANKS spoke thusly to: DICK ROEBELT
RW>RW>DR> FYI, the FF&C clause has nothing to do with driver's
RW>RW>DR> licenses at all. That is done through the Driver's License
RW>RW>DR> Compact laws in all the states.
RW>RW>That right I did :(. DL, along with most other license
RW>RW>issued by the states, are not "public acts, records, or
RW>RW>judicial proceedings" but if you read on you find
RW>RW>"Congress may by general laws prescribe the manner in
RW>RW>which such acts, records, and proceedings shall be
RW>RW>proved, and the effect thereof." From my reading the
RW>RW>Congress could pass a law stating that CCW are records
RW>RW>that are now covered by the FF&C clause (along with all
RW>RW>other state issued licenses.).
RW>DR> Congress may well try. But it will be in contravention
RW>DR> to the federal court edicts on the subject.
RW>I don't see how. According to my copy of the
RW>Constitution it would be perfectly legal. I quote
RW>Article IV, Section 1:
RW>"Full faith and credit shall be given in each state to
RW>the public acts, records, and judicial proceedings of
RW>every other state. And the Congress may by general laws
RW>prescribe the manner in which such acts, records, and
RW>proceedings shall be proved, and the effect thereof."
Read it again and again and again. Where does it say that Congress
shall be the sole determiner of which records??? It says "shall be
proved...." and nothing more.
RW>Therefore if the Congress prescribes by general law
RW>that CCW are public acts that will and must be given
RW>full faith and credit they would have to be. I don't
RW>see how any court could claim other wise when it is
RW>written right in the Constitution.
Congress does NOT have that power. That is reserved to the states.
And it is NOT written in the Constitution that I can see. Care to
show me?
RW>DR> Congress, hopefully, isn't that stupid to once again
RW>DR> trample the Constitution with the mood the country is in so
RW>DR> I don't see this happening any time in the near future,
RW>I don't see it happening any time soon either but I
RW>can't see how it could be considered trampling the
RW>Constitution if they did.
Try reading the Bill of Rights. Specifically Art. XI and X.
