I don't disagree. But it still is a rights issue. The historical way in
which Marriage only is a supported function is dysfunctional. The only way
for that to change is by fiat.

By will. In most states, a surviving spouse can "renounce the
will" and take a statutory share. In Illinois, it's 1/2 with no
surviving children, 1/3 if there are.
