Below is a letter Don and I faxed to the Judge in Daryl's case. We wanted
the Judge to understand our position. We went to counseling instead of
going to court with Daryl. We told Daryl that if he violated his probation
or forced us to have him removed, then he would suffer the consequences on
his own. I guess he didn't believe us. Today the Judge further detained
Daryl, revoked his probation, and made the two misdemeanor charges part of
his juvenile record. On August 14th, the Judge will decide where Daryl will
be placed. The Judge can keep Daryl in Juvenile Hall, send him to a Boys
Ranch, or send him to a Sex Offenders Treatment Center. These are the most
likely choices. We don't know what will happen to him, and although we care
where he ends up, it's out of our hands now and there is nothing more we can
do for him. The counseling center told us (today) that the amount of help
Daryl needs is beyond their expertise and there is nothing more they can do
for him either. As much as I know in my heart that we are doing the right
thing for him, it is still difficult. We have no idea how this will affect
our case with Michelle on Wednesday, August 2nd, but we are still hoping for
a good outcome. Daryl may have blown this for us though. CPS has been
informed (by us through our counselor) of what's happened and how we handled
it. Believe it or not, CPS said we did the right thing! I'll keep you
updated on both cases, and thanks for listening! --- Val

RE: Continued Detention of Daryl Frosty
To The Judge of Central County Court,
We are asking for your help in a most serious matter. We are requesting
that you continue to keep our son, Daryl Frosty, detained in an appropriate
facility until his emotional/mental problems have been completely resolved.
Daryl is in need of a great deal of intensive, long-term therapy. At this
point in time, the seven months that Daryl has spent in out-patient therapy
has not been successful as there has been no change in his behavior nor has
there been any signs of real remorse for the molestation of his sister. This
is the fourth counseling program that Daryl has been in during the last 5
years. Over the past several years Daryl has kept the family in a constant
state of emotional distress with his consistant misbehavior, his demands for
negative attention, and his numerous FALSE reports of child abuse against us.
Daryl seems to have no concept of morality (despite our efforts to teach him
otherwise), and although he will say that he knows his behavior is wrong, he
does not seem to FEEL that it is wrong and he behaves accordingly.
According to Ron Bell, Daryl's counselor, Daryl has been telling grandiose
lies in therapy, even as recently as 7/21/95, and he tends to live in his
own world. Daryl does not see reality the same way that most people see it,
although he is very good at convincing people otherwise. Daryl has indicated
in counseling that he has no respect for females (as his parents, we know
first hand that he has no respect for our rules or the feelings of others).
Still according to his counselor, Daryl seems to feel that the world owes
him the opportunities that he wants to take advantage of and he feels he is
justified in doing what he chooses to do regardless of the consequences. He
feels that if he is capable of manipulating people then he should be free to
do it. The counselor is aware of Daryl's threats to commit suicide and
believes that Daryl has no real desire to die, but could and possibly would
attempt suicide simply as a dramatic attempt to gain attention. If Daryl had
not been detained by the Probation Department on 7/27/95, he WOULD have been
detained on a 51/50 by his counselor and the Director of Turning Point
Counseling Center in Walnut Creek on 7/28/95.
We have observed in Daryl what we call a lack of conscience. His counselor
defines it as an undeveloped conscience, and he is very concerned about it,
as are we. Daryl is extremely manipulative and very adept at fooling people.
He could be an exceptionally convincing actor or writer if he would be
willing to use these traits in an appropriate manner; however, Daryl has
boasted to us on many occassions that he enjoys manipulating people, he
likes to play head games with them, it is fun. Those are his words, not
ours. Daryl has also stated to us that he has grown rather attached to
lying and that he sees no reason to stop doing it if it will help him get
what he wants. His lack of remorse for his actions is a great concern to
us. Daryl had also told us, prior to being detained, that it would be a
cinch for him to convince a counselor that there was nothing wrong with him
if we were to proceed with having him removed from our home. According to
his statements to us in a phone call on 7/28/95, he has been successful at
that with the counselor at Juvenile Hall.
Although most people tend to write off much of Daryl's behavior as that of a
typical 16 year old boy, we know better. Daryl is not a typical 16 year old
boy, although he can easily create that appearance to others. He is not
simply a very confused 16 year old boy either. Daryl is need of a great deal
of help and he can not get it at home (in ANY home) nor can he get it on an
out-patient therapy basis. We honestly do not know where the best placement
for Daryl would be, but in our hearts we know that the best place for Daryl
is NOT in our home. As it is, two of our sons began sleeping with baseball
bats and our 17 year old daughter began to sleep with her door locked, all
this out of fear that Daryl may come into their rooms during the night.
(This has only been during the last week that Daryl was at home.) What IS
best is for Daryl to get the help that he needs, and for his family to once
again be able to live in peace and to feel safe in their own home.
Sincerely,
Donald and Valery Frosty
