I'm truly surprised that flew in court.  The knowledge of the radio
transmission was still obtained illegally.  The lawyer would have to
tell, in court, that he obtained the tape recordings after a third party
who heard them over the radio passed the information along.
Again, not that the officer didn't have it coming...
