That's right; he keeps saying that it is not owned, but it is owned by 
microsoft.  Microsoft has chosen not to use http://www.microsoft.org>, 
but the domain microsoft.org is owned by them.  For some reason, he 
thinks that because the site isn't up and active, it's fair game.

There is still the matter of trademark infringement, and depending on 
how he would use it, possibly fraud.

I agree; they fought so hard to keep the World Wrestling Federation from 
using it, saying that it infringed upon their prior trademark, and 
violated a contract between the two organizations; by not paying for the 
domain themselves, and allowing another party that is unrelated to them 
have it, they have shown that their original cases was bogus and 
spurious.
