You haven't been reading the newspaper, have you? The Constitution was
written with the intent that no law be passed that was contrary to it, but it
also recognizes the need to allow recourse in case some non-compliant laws
were passed. Recourse is *very* time consuming and expensive. Consequently,
lawmakers who believe that an un-constitutional law is needed have little to
worry about, because 1) few people even know what the Constitution says, 2)
most folks are too busy to care what the Constitution says, and 3) almost no
one has the money or time to successfully appeal such laws.
The best way to get the bad laws out is to vote in politicians that will work
to repeal those laws, but because of 1) and 2) above, that too is extremely
difficult.
