subject: Hit & Run Accident

EF> Although he was around for a few minutes after the accident occurred,
EF> the driver of the Caravan fled the scene on foot before any police or
EF> emergency vehicles arrived on the scene.
EF> This is my question... how does the legal and or insurance liability
EF> work in a situation like this?
The accident will be classified as a hit and run accident. The police will
attempt to locate this driver and file charges on him. Regardless, the owner
of the Caravan should use his or her insurance to settle the matter. The
owner of the Caravan might be the same man who fled the scene, and that would
make things much easier, especially since there are several witnesses who can
probably identify him. There are two problems I can think of that might
complicate things greatly: 1) there is no insurance on the caravan; 2) the
owner of the Caravan reports the vehicle stolen, and he was not the man
driving the van.
In the two worst case scenarios above, you would need an insurance policy
with liability, comprehensive, collision, and uninsured motorists. You could
then collect from your own insurance company. All of this information is
generic, as I am not aware of the specific insurance regulations in your
state. This is what would happen in Oklahoma. I hope this helped some.
