 BJ> Re: Our Client:
 BJ> U.S. Scanner Publications
 BJ> Matter:
BJ> Defamatory statements posted on Internet by Larry Van Horn
 BJ> and republished by Scan-L
 BJ> Gentlemen:
 ...
BJ> Mr. Van Horn also states that the writers groups for USSN had been
BJ> fired or, alternatively, were on strike. Again, this is entirely
BJ> false. When U.S. Scanner Publications recognized it was unable to pay
BJ> outstanding obligations to its writers, it promptly informed the
BJ> writers groups that it was unable to pay for services rendered but
BJ> fully intended to pay all fees owed as soon as possible. Copies of
BJ> the correspondence relating to the relations between writers for USSN
BJ> and the RCMA group are enclosed.
 ...
BJ> The defamatory statements have resulted in a significant number of
BJ> calls to U.S. Scanner Publications as well as an ever growing number
BJ> of individuals who are calling to indicate that they will not
BJ> subscribe until there is some assurance that their subscriptions will
BJ> be honored and value received in the form of publications.
BJ> WE DEMAND that each of the individuals and organizations named above
BJ> immediately place full-page ads in U.S. Scanner News Magazine,
BJ> Monitoring Times and Satellite Times specifically retracting the
BJ> defamatory statements regarding treatment of staff writers, the
BJ> characterization of subsequent writers as scabs and the false claim
BJ> that subscriptions were not honored when U.S. Scanner Publications took
BJ> over U.S. Scanner News Magazine. The ad should also specifically state
BJ> that no writers were fired and U.S. Scanner Publications has committed
BJ> itself to paying all writers for services rendered when financially
 BJ> possible.
"...committed itself to paying all writere for services rendered WHEN
 FINANCIALLY POSSIBLE." (Emphasis added)
ANd when will that be? USSN certainly appears to be in its death throes,
 now.
USSN has already failed in it's committment to pay its writers; they admit
 that. What's another committment worth?
 ...
BJ> Although we demand retractions to mitigate the potential damages to
BJ> U.S. Scanner Publications, we are not waiving any claims for damages.
BJ> We are in the process of determining the scope of damages and will
BJ> advise you immediately once we have made an accurate determination of
BJ> the amount, if any, of ultimate financial injury.
How can you determine the scope of damages to a dying entity? It's obvious,
to me, that USSN is having serious financial problems, and had them long
 before this came about.
IMO, this is little more than an attempt by USSN to blame their own problems
 on someone else.
BJ> Do not underestimate the seriousness of my client's demands. The
BJ> unilateral action taken by Mr. Van Horn has and will continue to have
BJ> adverse financial impact on U.S. Scanner Publications. It is both
BJ> outrageous and irresponsible that such information could be
BJ> distributed so freely with the knowledge of the potential harm. We
BJ> fully intend to proceed with all of our legal remedies but believe it
BJ> is in your best interest to publish retractions promptly. Please
BJ> deliver copies of the retractions so we may review them first to
BJ> ensure they do not contain additional false statements.
IOW, kiss our ass, but we'll probably sue anyway. OH, and before you kiss,
we get to see what color lipstick you're using.
Why can't business people ever admit they've lost, and go under quietly?
