If his machine came with W98, and that's a very likely assumption, and he
simply can't find the CD's, then it's definitely NOT piracy, he paid he's
allowed to play.
All he needs is a bill or manual or paper license, even a magazine ad
showing that his computer came preloaded with Win98 and he can prove to a
court that he is legally running the OS. I've been to court over software
licensing issues, we had paid for the software but the rep had loaded a
copy he had sold to another company (he never paid the company who made the
software for the copy he sold us) and the result was they HAD to honor the
license and go after the rep for non-payment since he was authorized to
sell copies of the software. OEM's who preload fall into that same category
as long as you can prove your machine came preloaded.
