What then constitutes a right? 
simply my claiming that I have a right do something?

When can the government pass a law saying I can not, 
for example,have open fires in my back yard?
 
What makes this a right, or not a right?

The county of la can pass a law saying that i can not have open fires in
my back yard, and this contradicts no existing law. the 'right' to have
open fires stopped when the law against them was passed.

When the county of la passes a law saying that i can not carry and bear
arms, then that specifically contradicts the second amendment, and
should be an unconstitutional law.
