   An automatic copyright exists from the time the photo is put into a 
tangible format (able to be viewed).
   The photographer holds (owns) the copyright until s/he assigns it 
to another.

   Yes, there would be a problem.
   The copyright holder (the photog) has EXCLUSIVE rights to the 
reproduction and distribution of his creation.  So, if you want dupes - 
then you'll have to get them from him.  Or get an assignment of 
copyright so you may make your own copies.
