DALE WEIN spoke thusly to: MATTHEW KIWALA
DW>-> So, as a photographer, I'd like to point out that a lot of what
DW>-> you are offering to scan is probably copyrighted. Are you being
DW>-> careful not to
DW>Hey this is very interesting! Since I also am involved in this type
DW>of work, maybe you could tell us more. It seems to me that such
DW>items would obviously be personnal. How could someone have their
DW>wedding/vacation/historical photos/personal documents copyrighted?
An automatic copyright exists from the time the photo is put into a
tangible format (able to be viewed).
The photographer holds (owns) the copyright until s/he assigns it
to another.
DW>And if they are copyrighted, and the owner wants to have them
DW>scanned, how can there be any type of problem?
Yes, there would be a problem.
The copyright holder (the photog) has EXCLUSIVE rights to the
reproduction and distribution of his creation. So, if you want dupes -
then you'll have to get them from him. Or get an assignment of
copyright so you may make your own copies.
