That is exactly what should happen. They will file civil suit against the
other driver to get their money back. Since you had witnesses who can
probably identify the driver, the police will probably be able find the
driver and file charges on him. It sounds like you have a pretty good
insurance company since they have offered to pay already without being
pushed. Good luck.
