Huh? Who cares about the the civil aspect? We were discussing the
persons criminal liability and the possibility of some jail time while
he waits to have the truth come out.

Because of the seriousness of that particular situation, I would
agree with you. However, I would not be hesitating to pull out my
CCW permit.
