Which courts? Which levels? I wouldn't expect any court
other than a Supreme Court to want to tackle this issue..
Unless the State Supreme Court (or better yet, Federal)
decides that it is ok, local courts are going to "play it
safe" - I'm still confident that there's ultimately no
problem with this approach...
